Welcome to "Dolphin" – an online service in the field of diving, which includes a digital dive log, information about various businesses operating in the field of diving, and additional services. The "Dolphin" services are provided through an application (app) for smart end devices, as well as through the website operating at divedolphin.com, or at any additional address at the discretion of the Service Operator (the application and the website, including the services provided therein, shall hereinafter be collectively referred to as: "the Service"). The Service is managed and operated by Swid Technology Ltd., company no. 516959251, of 156 Menachem Begin Rd., Tel Aviv-Yafo 6492108 ("the Service Operator" or "we"). These Terms of Use set out your rights and obligations when using the Service. Your use of the Service, and any action you perform through it, constitute your consent to these terms and to additional terms appearing in the Service, including the Service's Privacy Policy, as well as additional instructions or guidelines that may be presented to you ("you" or "the User") during your use of the Service (collectively: "the Binding Documents"). Please read the Binding Documents carefully, as they constitute a binding agreement between you and the Service Operator. The Binding Documents may change from time to time, as set out in these terms below, and we therefore recommend that you keep up to date with them. If you do not agree to the terms of the Binding Documents, in whole or in part, you must refrain from using the Service. Use of the Service is permitted only to adult users aged 18 and over, or to any registered corporation or other lawful legal entity. The Binding Documents apply to use of the Service through any computer or other communication device (such as smartphones and smartwatches, tablets, etc.). The Binding Documents are drafted in the masculine form for convenience only, and they refer equally to all genders. Anything stated in the singular also refers to the plural, as the context requires. Using the Service and receiving and sending information in real time through the Service require an online connection of your end device to the Internet. The costs of such a connection are subject to the agreements between you and your communication providers and to the charges applicable to you. The term "Content" in the Binding Documents means any verbal, visual or audio content, or any combination or part thereof, as well as its design, processing, editing and manner of presentation. The Service may include translation of its content into other languages, including translation of the Binding Documents. In any case of conflict between the content of the Binding Documents in the Hebrew language and their content in any other language, the Hebrew version is the binding version (unless and where expressly stated otherwise).
"Dolphin" is an online service in the field of diving, which also includes a digital dive log, information about businesses in the field of diving or in related fields (such as diving clubs, insurance companies that sell insurance to divers, and more), information about diving courses and reviews of them, a guide to safety and immediate assistance, emergency services contact details, and additional services. The Service allows you to set up (and update) your diving profile, document your dives and experiences, upload accompanying documents (such as insurance documents), and more. In addition, you may upload a profile picture that will represent your account in the Service, and update it. Please make sure to upload only pictures that you have the right to display or use. The dive log allows you to document dive sites you have visited, the dates of your dives, the diving clubs whose services you have used, and more. If you wish the diving club at which you dived to confirm your dive in the digital log, we will ask you to approve sharing with the diving club, for a limited period (30 days), your diving-related details, including your name, phone number, date of last dive, diving profile details and certifications, documents such as insurance documents and diving license, and your diving history at that club. During this period, the club will be permitted to view your details in order to confirm and document your dives – as stated, only if you approve this. Such diving club will not be exposed to dives you performed at other clubs. You may cancel the information sharing at any time, in the list of diving clubs. This description does not exhaust all the ways in which the Service can be used. Additional information about the Service, its features and the ways in which it can be used can be found in the Service itself, or by contacting us as set out below. The Service also displays information about businesses in the field of diving and in related fields. These businesses may change at any time the range and variety of the products or services they offer. If you believe that the description and information about any external business, or about any of the products or services that such businesses offer, is insufficient, or if you believe that it is misleading, inaccurate, or requires further attention for any other reason - do not hesitate to contact us using the contact details set out in these terms, so that we can consider whether to remove them from the Service, or take any other action. The publication of products or services of third parties in the Service does not constitute a recommendation by the Service Operator to purchase the products or services, and you must exercise independent judgment before you enter into a transaction with any third party following an advertisement to which you were exposed in the Service. The Service Operator does not offer or provide the products or services of third parties whose information, or a link to which, is published in the Service. All responsibility for the publications of such businesses, and for the products and services they offer, including their features, quality and any other aspect involved therein, rests with the businesses concerned and with them alone. The Service Operator does not supervise such businesses, their products or their services. Responsibility for the information, its quality, its reliability and for the products / services of the businesses rests entirely with the businesses themselves. The Service also includes informational material and content in various professional fields. For the avoidance of doubt, such content in the Service is intended to provide general information and guidance only, such as the content in the Service relating to the guide to safety and immediate assistance, and the emergency services contact details. Such information and content do not constitute an opinion, recommendation or professional advice, and are not a substitute for individual advice that takes into account the specific data and needs of each user. Any reliance on the information presented in the Service is at your discretion and under your full responsibility. Although the Service Operator acts reasonably to ensure that the information and content we present in the Service are correct, up to date and reliable, the Service Operator does not guarantee the accuracy, completeness and currency of the information, nor its suitability for any purpose. The Service Operator has the discretion to decide which services, businesses, content and information will be presented in the Service, the length of time for which they will be presented, their placement and design and any other matter related to them, including to remove any content or information from the Service at its sole discretion. The settings area of the Service also includes location-based services, which use GPS technology to determine your location as a user of the Service, through your end device, for example for the purpose of using your location to mark in the Service the dive site at which you dived, for the dive log, or to display diving clubs, emergency numbers and benefits suited to your location.
Subject to full and precise compliance with the provisions of the Binding Documents, the Service Operator grants the User a non-exclusive, time-limited, revocable, non-transferable permission, without the right to grant sub-licenses, allowing the User to use the Service for the User's personal and private purposes. This license does not permit the User to use the Service commercially in any way. In particular, content from the Service may not be publicly displayed or made available to the public, and access rights to the Service may not be sold or granted to any third party.
Use of the Service, including registration for it, is permitted only to adult users aged 18 and over, or to any registered corporation or other lawful legal entity. Use of the Service is free of charge. Use of the full features of the Service requires registration, provision of the information requested during registration and your consent to the terms of the Binding Documents (and in particular these Terms of Use). The full features of the Service cannot be used without completing the registration process. If you choose not to register for the Service, you will be able to browse only part of the Service's content, but not to make use of its full functionality. When you wish to register for the Service, you will first be required to enter and provide us with your full name, date of birth, your phone number and email address, and to choose a password that you will use to access the Service (mandatory fields will be explicitly marked). For verification and identification purposes, we may send you verification messages using the contact details you have provided to us. After completing the first part of the registration process, we will ask you to set up your diving profile, in order to document dives, track the certifications you hold in the field, and enjoy various benefits that may be available to registered users. When setting up the diving profile, you will be asked to enter personal details relating to you as a diver, such as: your diving level (number of stars, Master Diver, Assistant Instructor, etc.), specialties (photography, Nitrox, buoyancy, and more), weights, fin size, diving suit size, profile picture, and more. You may also register for the Service through your account on social networks and third-party services such as Google and Apple. When you register for the Service through your account on such a third-party service, you allow us access to basic information about you on that service, such as your name, your email address, your picture, and any other information and content available for viewing in your account on that service. Our access to such information and content is limited to the information and content to which the operator of the third-party service allows us access, in accordance with your privacy settings on that third-party service, which you can change from time to time through the interface that the service makes available to you. Your use of such third-party services is, of course, subject to the agreements between you and those services, and not to these terms. You must provide only correct, accurate and complete details, and you hereby confirm the correctness of the details you have provided. Providing incorrect details may prevent you from being able to use the Service, or to use it properly, and, where necessary, may frustrate contacting you when required. Without providing the information requested in the mandatory fields, you will not be able to complete the registration or perform the relevant action. The Service Operator reserves the right to take various measures and to request additional details from you in order to verify and confirm your identity, and also to add, from time to time, other and additional registration methods. The details you provide during registration (as well as actions you perform while using the Service) will be stored in the Service Operator's database, and the Service Operator will use this information in accordance with the Service's Privacy Policy, which is an integral part of the Binding Documents and which we recommend that you review. You may be required from time to time to enter the registration details you provided to the Service Operator, for the purpose of reconnecting to the Service in the event of logging out of/disconnecting from it. To prevent misuse of your account in the Service, you must keep these access details in strict confidence. They must not be shared in any way with any third party, nor may access to your account in the Service be allowed in any other way. You bear full responsibility for any use made of your account in the Service, including as a result of your failure to keep the access details to your account in the Service confidential. If you become aware, or reasonably suspect, that the security conditions have been breached or compromised, including, without limitation, any loss, theft or unauthorized disclosure of the access details to the Service, you must notify the Service Operator immediately and act in accordance with its instructions.
The Service Operator may prevent you from using the Service, at its discretion, and it may also block your access to the Service, or cancel or suspend your account in it, inter alia in any of the following cases - • If you provided fictitious or incorrect details; • If you performed an act or omission that harms, or may harm, the Service Operator or any third parties, including other users or suppliers and partners of the Service Operator; • If you used the Service, or any of its content, to attempt to perform an illegal act, or an act that appears on its face to be illegal, or to enable, assist or encourage the performance of such an act; • If you breached the terms of the Binding Documents; • If you perform any action that prevents others from using the Service in any way; • Upon the cessation of the Service Operator's activity or the termination of the Service's operation; • Pursuant to a judicial order, or an instruction of a competent authority or tribunal; • If you provided or disclosed the access details to the Service that were assigned to you for the use of a third party, or if you gave a third party a right of access to the Service in any way; The Service Operator may employ various measures to monitor activity in the Service and in order to detect cases of fraud or misuse of it. The Service Operator reserves the right to block or cancel your access to, or registration for, the Service, at its discretion, if it believes that your account in the Service was used to perform such acts. You may delete your account at any time through the settings area of the Service.
The Service does not sell products or services independently and does not serve as an e-commerce site. In most cases, the advertisements or publications in the Service will link you to the website or application of the relevant advertiser. Please note that when you move to the website or application of an advertiser in the Service, you are subject to the online agreements that apply to the use of that website or application, not to the Binding Documents of Dolphin. You will have no claim against the Service Operator regarding the quality or nature of the activity on the website or application of the advertiser to which the Service refers you. See also, in this regard, the "Links" chapter below in these terms. The Service includes the display of commercial content, such as advertisements, referrals and notices, submitted for publication on behalf of various advertisers (such as diving clubs, insurance companies, etc.) who seek to offer products or services for sale, including information originating from various business partners. The Service Operator bears no responsibility for the commercial content published in the Service on behalf of third parties. The Service Operator does not write, check, verify or edit the content of these publications or their accuracy. The sole responsibility for the commercial content and for any consequence arising from its use or from reliance on it rests with the advertisers. The publication of commercial content in the Service does not constitute a recommendation or encouragement on the part of the Service Operator to purchase the services, assets or products offered for sale in it. Any transaction made following commercial content published in the Service will be concluded directly between you and the advertiser. The Service Operator is not a party to any such transaction and will not bear responsibility for the services and goods offered in advertisements or commercial content displayed in the Service.
Where you give your consent to this in accordance with the requirements of the law, where such consent is required, the Service Operator may use the contact details you provided in order to send you updates, by email, by text messages (SMS), by instant messaging services, or in any other way, including content updates, newsletters, surveys, information about services and products (of the Service Operator and of others), promotions, new features in the Service and advertising messages, inter alia within the meaning of these terms in Section 30A of the Communications (Telecommunications and Broadcasting) Law, 5742–1982, as well as by direct mailing under the Protection of Privacy Law, 5741-1981. At any time, you may withdraw your consent and notify the Service Operator of your refusal to receive advertising messages, generally or of a particular type, by sending a refusal notice. The method for sending the refusal notice will be specified in the advertising messages sent to you by the Service Operator or anyone on its behalf. Please note that even if you give notice of your refusal to receive advertising messages, the Service Operator may continue to contact you with messages of an operational nature relating to your activity in the Service (such as satisfaction surveys, notices of scheduled maintenance, etc.). When using the Service through the application, we may ask you to approve receiving pop-up notifications (Push Notifications), to the extent that your end device supports this. If you approve this request, the Service Operator may send you such notifications through the application interface or your end device. Sending these notifications is a built-in feature of some end devices. The Service Operator is generally unable to turn off or disable this feature on your device. If you choose to stop receiving these notifications, you will need to remove this feature directly in the application itself, by using the relevant settings menu on your end device.
Without derogating from the other provisions of the Binding Documents, you may use the Service in accordance with the rules set out below. The Service may not be used in any other manner, unless you have received the express consent of the Service Operator to do so, in advance, in writing and subject to the terms of such consent (if given) - • You may use the Service for lawful purposes only and in accordance with the provisions of the law. You may not use the Service for commercial purposes, but for personal and private purposes only; • The Service must not be used in a manner that constitutes, or may constitute, a criminal offense or a civil wrong under the provisions of any law, or that infringes the rights of any third party, including the right to privacy or intellectual property rights. For example, take care not to upload to the Service photographs in which you do not hold the copyright, or a permission to use them; • Content from the Service must not be copied and used, nor may others be allowed to copy and use it, in any other way, including on other websites, in applications, in electronic publications, in print publications, etc.; • No computer application or any other means, including software such as Crawlers, Robots and the like, may be operated for the purpose of automated searching, scanning, copying or retrieval of content from the Service. In particular, such means must not be created or used for the purpose of creating a compilation, collection or database containing content from the Service; • No means may be employed to circumvent, disable or overcome the security mechanisms of the Service, and its proper operation must not be harmed or interfered with in any way; • Content from the Service must not be displayed within a frame (Frame), whether visible or hidden; • If you have registered for the Service as set out in these terms, you may use the Service through one user account only; • Content from the Service must not be displayed in any way – including by means of any software, device, accessory or communication protocol - that alters its design in the Service or omits any content from it, and in particular advertisements and commercial content; • You undertake not to mislead, deceive, make false representations or provide incorrect information when using the Service, and that you will act in good faith towards the Service Operator when using the Service; • The Service must not be linked to from any source that contains pornographic content, content that encourages racism or improper discrimination, or that is contrary to the law, or whose publication is contrary to the law, or that encourages activity contrary to the law.
You will find in the Service links to various pages on the Internet. Some of these links are intended for general information, such as a link to emergency call centers, and some are links to websites or applications of businesses that present their services or products in the Service. The links enable you to find content published on the Internet. Such content is not published by the Service Operator or on its behalf, and the Service Operator does not control or supervise it. The fact that the Service links to such content does not indicate the Service Operator's agreement with its content and does not constitute a guarantee of its reliability, currency or legality, of the privacy practices of the content owners, or of any other aspect involved therein. You may find that such content does not suit your needs, or that you object to its content, or believe that it is outrageous, annoying, inappropriate, illegal or immoral. The Service Operator is not responsible for the content to which the links lead and is not responsible for any consequence arising from their use or from reliance on them. The Service Operator does not undertake that the links found in the Service will be functional and will lead you to an active web page, and it may remove from the Service links that were previously included in it and add or remove new links, at its absolute discretion.
The Service Operator respects your privacy when you use the Service. The Service's Privacy Policy is an integral part of the Binding Documents. Since the Privacy Policy may change following changes in the Service, according to our operational needs, or following changes in legislation and regulation - we recommend that you keep up to date with the Privacy Policy document from time to time. The current Privacy Policy of the Service will be published at all times in the application itself.
All intellectual property rights in the Service, including patents, copyrights, registered designs, designs and trade secrets, are the property of the Service Operator alone (except for content submitted for publication by users and businesses), or of other third parties who have permitted the Service Operator to use them within the framework of the Service. These rights apply, inter alia, to the trademarks appearing in the Service (whether registered or not), its commercial symbols, the graphic design of the website and the application, its databases and any other content included in the Service, including the computer code of the Service and any other detail related to its operation. You may not copy, modify, publish, distribute, market, translate, publicly display, communicate to the public or make available to the public, adapt, create or make derivative works, sell, rent or make any commercial use of any part of the foregoing, including images, graphic files, texts and computer code, whether by you or through or in cooperation with a third party, in any way or by any means, whether electronic, computerized, mechanical, optical, photographic or recording means, or by any other means and manner, without obtaining the prior written consent of the Service Operator or of the other rights holders, as the case may be, and subject to the terms of the consent (if given). Any content you upload to the Service, such as photographs or textual information, will remain in your full ownership, but you grant the Service Operator a license to copy it to the Service's content management systems, in order to enable the Service Operator to make that content available to you and to enable the functionality of the Service. The trademarks and advertisements of advertisers in the Service and of the businesses are the property of such advertisers and businesses alone. These, too, may not be used without the prior written consent of the advertiser or business.
The Service Operator respects the rights of others, including the intellectual property rights of third parties as well as their right to a good name and to privacy. Some of the content in the Service is entered into it by its users and by businesses that advertise in it, and not by the Service Operator. If you believe that any content published in the Service infringes any rights you have, you are invited and requested to inform the Service Operator thereof immediately in writing, using the contact details specified at the bottom of these terms. Steps taken by the Service Operator, if taken, in reliance on information delivered to it, will not constitute proof of the infringement of any right, and they will be taken in accordance with the provisions of the law.
Wherever the Binding Documents set out the liability of the Service Operator, or the absence of such liability, this shall also refer to the liability of its employees, managers and those acting under its authority, in its name or on its behalf. Use of the Service, the website, the application and any content or service included therein shall be at your sole and full responsibility, and the Service Operator shall not bear liability for any direct or indirect damage caused to you, or to anyone on your behalf, or to any other third party, including any loss, forfeiture or expense, related to, or arising, directly or indirectly, from the Service, or from any direct engagement of yours with businesses that advertise in the Service, including from reliance on the information published by businesses, or with respect to the quality of the products or the products they offer, and their features. The "Dolphin" services are provided for use as they are (AS IS). They cannot be adapted to the needs of every person and user. You hereby confirm that you have examined the Service and found it suitable for your needs and purposes. You will have no claim, suit or demand against the Service Operator in respect of the Service's features, capabilities and limitations, the rules applicable to it and its suitability for you and your needs. Any decision you make with respect to the information published by the businesses is at your full and sole responsibility. The Service Operator does not undertake that the products and services offered by the businesses will meet your expectations and requirements. The Service Operator encourages you to treat with caution and with a critical eye the content published by the businesses that advertise in the Service, or that present their services in it. Such content is not published on behalf of the Service Operator and therefore it is not responsible for its credibility, reliability, accuracy or completeness and is not responsible for any consequence arising from its use or from reliance on it. The Service Operator strives and does everything in its power to provide you with a proper, high-quality service. However, the Service Operator does not undertake that the Service's services will not be interrupted, will be provided regularly or without interruptions, will operate securely and without errors, and will be immune from unauthorized access to the Service Operator's computers or from damage, breakdowns, malfunctions or failures - all of the foregoing, whether in hardware, in software, or in communication lines and systems, at the Service Operator or at any of its suppliers. The Service Operator shall not bear liability for any damage arising from the loss of your details or of the information in your account, or from the corruption of such details – whether in whole or in part, as a result of a failure in your computer systems or in those of the Service Operator, or of anyone on its behalf.
Without derogating from the provisions of any law and of the Binding Documents, you undertake to indemnify the Service Operator, its employees, managers or anyone on its behalf, for any damage, loss, loss of profit, payment or expense incurred by them - including attorneys' fees and legal expenses - as a result of a breach of these Terms of Use or of any of the Binding Documents. In addition, you shall indemnify the Service Operator, its employees, managers or anyone on its behalf, for any claim, suit or demand raised against them by any third party as a result of your breach of any of the provisions of the Binding Documents.
Your use of the application may be subject to additional contractual provisions of third parties governing the use of the online store from which you downloaded the application, such as Google Play or the Apple App Store. Such provisions may also be deemed a contract for the benefit of such third parties, if so provided in those additional contractual provisions of third parties. In any event, such third parties are not responsible for providing support or maintenance for the application and are not responsible in any way for the activity in it. The Binding Documents are entered into between you and the Service Operator only.
The Service Operator may change from time to time the structure of the Service, its appearance and design, the scope and availability of the services, content and advertising options in it, and may change any other aspect involved in the Service - all without the need to notify you thereof in advance. Such changes will be made, inter alia, taking into account the dynamic nature of the network and the technological and other changes occurring in it. By their nature, changes of this kind may involve malfunctions or initially cause inconvenience, etc. You will have no claim, suit or demand against the Service Operator in respect of making such changes or malfunctions that occur in the course of making them. The Service Operator may discontinue the provision of the Service at any time, in whole or in part, temporarily or permanently. The Service Operator may also discontinue the activity in the Service from time to time for the purpose of maintenance, repair, upgrading and improvement of the Service. The Service Operator will do its best to minimize the periods of time during which the Service will not be active. Where possible, the Service Operator will publish advance notice in the Service of the discontinuation of the Service. Upon discontinuation of the Service, the Service Operator will retain the content included in the Service for a period of 30 days, and thereafter it may delete it without keeping any backup of it and without giving further notice thereof.
Images that may be displayed in the Service, such as photographs of dive sites around the world, or of diving products, are displayed for illustration purposes only. There may be differences between the images displayed to you and the actual state of affairs. This shall not impose any liability whatsoever on the website operator, or on anyone on its behalf.
The Service also includes referrals to various social media channels of the Service Operator, such as the Service Operator's page on Facebook, Instagram and other similar services. Use of these online services is at your sole responsibility and, by its nature, is subject to the legal agreements (such as the terms of use and privacy policy) governing the activity of each of these platforms (which are not operated on behalf of the Service Operator or under its control).
The Service Operator may change from time to time the provisions of these Terms of Use and any of the Binding Documents. Where possible, and if we make material changes to the Binding Documents, we will publish a notice thereof on the home page of the website or in the application interface, or we will notify you thereof using the contact details you provided to us. If we make such changes in accordance with the provisions of the law, or a requirement of a competent authority - the changes will take effect in accordance with the provisions of the law or such requirement. The links to the Binding Documents placed in the Service will always link to the current version of the Binding Documents. Continued use of the Service after we publish the updated documents constitutes your consent to them. The Service Operator may request your renewed consent to the Binding Documents, or to any of them, in any case of such a change, at its discretion. If you do not agree with the new provisions of the Binding Documents, you must stop using the Service.
The law applicable to the use of the Service and to the Binding Documents - is Israeli law only - without regard to its choice of law rules and regardless of your actual location as a user of the Service. In any dispute between you and the Service Operator, including in connection with the use of the Service, the Binding Documents, or with respect to any other matter, exclusive jurisdiction shall be vested in the competent courts in the Tel Aviv-Yafo District, Israel.
You may not assign any right or obligation under the Binding Documents, nor may you encumber, transfer, pledge or grant any rights therein to any third party without the prior written approval of the Service Operator. Any act or omission contrary to the foregoing – shall be void. You agree that the Service Operator may transfer its rights and obligations under the Binding Documents, at its discretion, including in any case of merger or acquisition, provided that the transferee assumes towards you the Service Operator's obligations under the Binding Documents.
If the Service Operator does not enforce any provision of any of the Binding Documents, this shall not derogate from the binding force of the provision or from any right or remedy vested in the Service Operator. If, for any reason, a competent tribunal determines that any provision of the Binding Documents is invalid or unenforceable, such provision shall be enforced to the maximum extent permitted, and the remaining provisions of the Binding Documents shall remain in full force and effect.
The Service Operator is careful to comply with the provisions of the law and respects the rights of the Service's users and of the general public. If you believe that we have published in the Service content that is incorrect or inaccurate, or that harms you for any reason, or that infringes your rights, and also if you have any question, suggestion, complaint, etc., please contact us at the email address support@divedolphin.com, and we will endeavor to handle your inquiry as soon as possible. In any section of the Service in which we enable you to contact us, or when you contact us in any other way, you must refrain from sending us, or contacting us with, inquiries that include content that is illegal, sexually explicit, harassing, insulting, hostile, harmful, threatening, vulgar or racist, that offends public sensibilities, encourages the commission of a criminal offense, may give rise to a claim or civil liability, is defamatory, invades privacy or otherwise constitutes a breach of the provisions of the law. The Service Operator reserves the right not to respond to offensive inquiries, without derogating from any other remedy available to it.
